1. Content Ownership and Platform License
You retain 100% ownership of all text, images, and historical documents you upload to our platform. By uploading content, you grant us a limited, non-exclusive, royalty-free license solely to process, format, and transmit your data to generate your digital proof and execute your print orders. We claim zero rights to your personal stories, manuscripts, or legacy materials.
2. Acceptable Use and Platform Safety
You are solely responsible for the content you upload to the platform. You agree that you will not upload, store, or process any material that:
- Infringes on the intellectual property, copyright, or privacy rights of any third party.
- Contains malicious software code, scripts, or files designed to disrupt the platform’s infrastructure.
- Is unlawful, defamatory, abusive, or intended to harass or exploit others.
We reserve the right to immediately terminate user access and remove data, without a refund, if an account is found to violate these platform safety boundaries.
3. Automated Software Limitations and Proofing
Our platform utilizes automated layout and editing technology to assist you in compiling your memoir. While our system provides advanced structural tools, grammar smoothing, and layout corrections, final proofreading, the accuracy of historical facts, and final layout approval are entirely your responsibility. We are not liable for any layout anomalies, typos, spelling errors, or narrative omissions present in your final approved digital proof.
4. Payments and Refund Policy
Purchases cover full platform access and digital PDF generation as outlined in your selected product tier. This is a one-time transaction. Due to the immediate delivery of digital access, software tools, and server provisioning, platform purchases are non-refundable once you have completed your registration by creating a username and password.
5. Third-Party Printing and Manufacturing Costs
Physical book printing is fulfilled through an external, print-on-demand automated facility (Lulu). Manufacturing, binding, and paper costs are set entirely by the printer, fluctuate based on current facility market pricing, and require an additional charge beyond your initial platform purchase. Final printing and shipping costs are calculated and locked in only at the exact time your print order is finalized and submitted.
6. Dispute Resolution and Governing Law
Any legal claims, disputes, or issues arising from your use of the platform, software tools, or fulfillment services shall be governed by the laws of the State of Arizona, without regard to conflict of law principles. Any legal proceedings must be handled in the appropriate courts located in Pima County, Arizona.
